This is the most sensible idea in a long time. And I agree with keeping it low profile. This would also give a reality for the Govt as to how many actual cases that are pending if in future they wanna do something with an actual law to really help out.

Hi all:
Thanks for all your advice and understanding. I could not post earlier as we were busy following up the case with the authorities. I have two lawyers on board and a wonderful, unexpected, child abuse NGO person helping us deal with the situation. Most importantly, the baby is in perfect condition after having everything scanned and reviewed with two pediatricians�.it is possible, as one person helping us mentioned that the rough handling may appear exaggerated on the video bcos low resolution cameras sometimes exaggerate slower movements into sudden and forceful movements (I don�t fully understand)- which is also ok w/ me as my child having been safe is more imp to me....at the minimum she will be deported and barred from entry, or likely fully convicted and behind bars...from what I have heard till now, we will likely not be penalized as there are some protection and immunities in these cases for those who testify (and most certainly INS will never be involved)�and at most there may be some fines�
....and to some others who have misread a few things I mentioned: a/ the baby did not remain with the nanny for even a second after we suspected something fishy b/ we were not saving money with this nanny: 350$ (plus food, commute, and phone cards is above average here even for a legal worker. Also we selected her after observing her (and earlier another nanny) at home for 2 weeks with the baby while my mom-in-law was there and all of us had felt for some reason that she was the better one��..and to everybody with kids: no matter how much you trust your nanny, however well referenced they are- use a nannycam�.you may amazed at what you see�.there is something about having the whole house to yourself with an infant that makes some people crazy- so that their suppressed anger/envy and whatever else is hidden comes out on a poor speechless baby.

Yes...I am aware of the facts that you mention...but now that data entry is made since long, the ND has no value.
Last year when the EB2 PD's were current for 28 days in August, only those RD's whose data was entered in TSC had chance of getting GC's. In other words, receipts are now generated for all '07 fiasco filers and hence the ND has no value!
That said if a Service Center rep says about the ND replacing the RD in their system, then it is time for corrective action. With these small windows of PD being current, why take chances!

It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as on the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07.

Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.

US immigration policy is to get foreign people only when certain skills are not available. There are lot of laws are there to protect US jobs while hiring Foreign persons. And some more may come while increasing immigration. Some times it might not be enforced correctly. It is the mistake of US enforcement agencies and Companies but not the mistake of immigrants. Many immigrants are creating jobs here. Yes you have to complain to authorities if any one violated immigration laws. But there is no use of blaming all the immigrants. There is nothing wrong in increasing immigration with the protection of American jobs. If protection is not enough then you can ask congress to increase more protection of US jobs. But moderate increase of green card is needed. And IV goal will not increase immigration numbers and will not create unemployment in Americans because the persons will stay till getting green card. So it does not make any difference if they increase or not increase GC numbers. But it will make many persons life easier.

:) Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. i concur with the aspect of filling a lawsuit, as it will create more visibility and put more pressure on congress. As it is congress is under the gun for failing to act on a lot of bills. Even though if it does not create instant results, it will definitely lead to some type of change in coming months. I am sure if we all pitch in 50$ each, we can accumulate good amount of money. Also we can use Murthy Law firm to file a lawsuit. Lets not forget the amount of visibility Murthy law firm is getting from IV. If there is a law suite filed through them, then they also get to share the limelight.
The point here is, we can get a discounted price on the service, also Murthy law firm is aware of our situation. Administrator what do you think?
All EB3 guys, stop complaining about EB2-EB3, it is about EB community. IF EB2 get some direct benefit, then it will be rolled down to EB3 as well. Please let us not discuss issues which separate us. Right now we should focus on unity and creating a mass number of high skilled workers who can SHOW up on rally's.

Sorry but I don't agree with your point that if EB2 benefits today EB3 would benefit tomorrow. It looks plain and simple but it's not so in reality. Unless all EB2 categories become current and EB3 ROW get the overflow and become current, EB3 I (or China or Mexico) is not going to be benefitted from EB2 getting a VISA! You are basically saying to EB3 filers to wait for another 10 years so that the EB2 queue may reduce so that EB3 queue would start moving. That's not a practical solution.
I think once there is an overflow (from EB1), then it should:
1. go to the category that's retrogressed more or
2. split the overflow among retrogressed categories and
3. go to EB2 if both EB2 and EB3 have the same cut off date.
Does US need more EB2 (than EB3) or need them sooner (than EB3)? If they need more EB2, then EB2 can get more numbers (but the restriction should happen at H1/L1 level). If they need them sooner, then they can be on a fast track. But by approving a EB3 or EB2 I140, the Govt. is saying that they need that particular applicant. A vast difference between these two categories at the last queue (485) does not make sense.
It is insane to ask a EB3 I 2001 filer to wait forever just because he filed under EB3 and grant a VISA to EB2 2004 filer! It is not different from granting a VISA to a EB3 2007 ROW filer and making EB3 I 2001 wait. EB2 is taking all the overflow which, in my view, is not correct. I have tried to explain the general approach taken by an American System in another forum. The moral of it is that don't think that someone (USCIS/senator/congressperson) does not know what they are doing. They know what they are doing and will continue doing it unless someone kicks their ass.
As an example, White House did not do the right thing with a Canadian citizen by sending him to his contry where he was tortured (the story was on last week; the person got millions from Canadian Govt). So far Republicans did not care about it. Last week a democratic committee chewed Gonzales's (in charge of USCIS also) ass. He said he will provide evidence soon.
I have been in similar situations where I have to do things not liked by some persons. I just act dumb and keep doing what I have to do unless someone much higher up chews my ass.
This is standard American procedure.

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item

If it is true, they have revised the process, and that is good. Hoever, it also depends on how the question was posed. If you asked whether processing is based on RD or ND, they will defnitely tell it is RD. One need to ask, which of two dates will determine case processing status, if your stamped RD is 3 months earlier than the receive date you see online. Note that the site tells you to contact them if your "receipt notice date" is prior to the published date, and you are still waiting. What is "receipt notice date"?
I did cearly tell her - both my RD and ND and asked her which one. She said there were some delays during that time to send a notice date hence the gap and it doesnt count.
