Yes IV members and other EB folks who are/will benefit(ing) from this are indebted big time to Aman and IV core. Com'on guys this fellow sold his house and spends a good chuck of his time for a selfless cause. IV core can sit on a couch like you and me watch TV, spend time with their family and not bother about contributing a penny. The least we could do is support them.

I did a quick search and did not find answer to this. Apologise if this is a repost.
But a co-worker of mine wants to travel on AP. After coming back, he will join my company (right now he is a contractor) as a perm employee on H1. Is it possible and allowed? Can he transfer H1 after using AP?
Our company attorney confirmed that his H1B will remain valid even after using AP. But she is not sure about transfer. I will post her reply once she gets back to him. But in meantime, if anyone has any idea about this, please share.

Xu1, that is a valid concern. I have sent in this request to admin. But on important issues like this, please do PM admin and other Moderators in addition to public posts. The core group is so drained by all the during the week activities that posts may not be actively monitored during weekends. I think the problem is also logistical, in that we are now getting a lot of checks - which is great, but also now, the core team members handling finances must now take time out to start sending email receipts. So wait for admin and the financial people to get back to you.
Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.

I actually had to go and visit the URL to really make myself believe that someone can be this dumb. Well to each his own.
One thing I did notice was the comment "it is soon becoming the voice of rich and/or EB2 Indians only -- all other categories will either have no direct advantage with the efforts put in by IV, or they will actually see some negative effect from its activities. But that will be the case with any organization that claims to stand for a particular class. In reality, every core group will stand up for it and only itself."
Does someone care to explain this? I am EB3-ROW, I have occasionally donated and occasionally called but I don't think IV has ever HURT my case?
On a side note: just on the off chance that the comment is true and IV is truly a community of RICH Indians: can I borrow some money? :D :D The eay I look at it, if 50 of these rich, EB2 Indians give me $ 10,000 each, I can get my GC by investment and I will pay you all back in 2 years. :p

1) Removal of per-country quota: Claimed to be fair for everyone. Not really. It only helps Indians and Chinese. ROW will see a serious degradation in the time they will get their GCs. 2) The Rich guy comment is based on the latest (supposedly supported by the CORE no less) action which is to ask for legislative changes if you have money to throw in to buy a house with 20% down.
So yes, I do stand by my statement that IV is devolving into less than general purpose immigration group.

All our I485 applications had a soft LUD of today. Recently I applied EAD for my son and it got approved within 15 days. One of my friends got LUD and later (after 2 days) a Hard LUD that they sent an RFE. Our SC is Nebraska. some of my friends also had got Soft LUD 2 weeks before but no change inside... Not sure what is awaiting us. Hopefully its all pre-adjudication. Any insights will be highly appreciated.

I don't mean to embarass you or make you feel awkward by thanking you every time you post, but the excruciating detail that you get into, in your posts, to back your statements never ceases to amaze me, and I know I speak for a lot of people here.
That being said, if I may bother you with one more question.
Lets assume that the 140 is revoked right after the employee leaves, and the employer had 100% abilitiy to pay the employee until that moment.
6 months after the employee left, and after the 140 was revoked, the employer gets an ability to pay RFE on some other pending or unrevoked 140 of theirs. In that case ,can the 140 that was revoked 5 months ago be in danger?
Of course, this is assuming that all AC21 memos till date are considered binding, and no memo changes to AC21 have happened.
USCIS uses three criteria in deetermining ability to pay;
1) net income is more then labor wage
2) net current assets is greater then labor wage
3) person is getting paid labor wage from date of filing labor
#3 is the only one that does not have dependency on employer financials and the # of filings that a company may have done. If person wasn't getting paid labor wage from date of labor filing then dependency is on company financials and if there is adding up together then there is issues.
If in 485 denial it is due to ability to pay and they state so in 485 denial and you were paid labor wage from priority date until you left and were eligible for ac21 then the denial would not have been in error and you would be fine.

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

This is not a waste of time. CNN really cares about rating and I am pretty sure for many people like you and me, CNN is the first stop for news. If they realize that we are a force to reckon with, they will think twice before airing such shows. By signing nobody is expecting, CNN firing Lou Dobb's but at least CNN will be careful airing these baseless facts..That's all we need..attention and fairness..espeacilly when they claim they are the most trusted name in the news..

Actually I know a guy who lost his job and joined a restaurant as a cook or something and applied GC, then after 1 yr or so got job again and used the EAD to change to the Tech Field again and at a different location.....I hear he is indeed facing some problems now.

Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.
