    I am not sure if you are being facetious but I think that is a great idea! :)
    No, I'm not being facetious :)

    There is always a chance that a well publicized (we are working on that part!) rally might attract opposition to the rally.

    I wholeheartedly think that this gesture would be seen as fairly "american" and could defuse tension if it arises. Plus it would link back nicely to the flower campaign as well, and the eventual destination of the bouquets sent.

    Political stance on wars aside, I don't think there are many people who don't support the lives on the line.

    I think you guys are organizing a watershed event for skilled, legal immigrants - I wish you great success.

    I cannot emphasize the importance of alerting media to this. Media attention is not at its best over the weekend so you will have to work extra hard to make sure that you get good media coverage. I hope that someone is working on creating a press release for the event.

    While we were creating the press release for the flower campaign, we were given the following advice by a friendly journalist

    Make sure that you have a catchy slogan and title for your press release and the event
    Don't let your press release be a big mass of text. Break it down into What, Where, When and Why (refer to flower campaign PR if you need to)
    In the media contact, absolutely have at least one contact with cell phone number and name. It is important that journalists can all and talk to a person if needed
    Also have a post event press conferenceAll the best guys.

    Lets ask Core not to just go with the temporary fix of July visa bulliten.
    We might apply for EAD and AP but what if they throw our papers some where and repeat the same thing.
    This time they will be very careful in issuing visa bulliten

    In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...

    This is not the fix
    We should be firm with our goals...

    Lets come up with some ideas....
    Lets not ask what to do...lets think and come up with an idea...and then we shall decide if it works or not...
    When some one first suggested flower campaign everyone took it as a joke...it was not implemented before some one sent the flowers and showed the receipt number...

    I was following core for a long time...this the biggest response i have ever seen from the members...

    My idea ...lets not just accept the temporary fix...we should fight the congress until they come up with a plan of fixing the GC issue.

    The congress talks about fixing illegal immigration..Lets ask them to fix the legal immigration first.

    Unless we are really strong about it...nothing can be accomplished..

    They cant fix the existing legal system but they are ready with the plans of fixing illegal immigration...of course it failed but still they had big impact...
    Dude, good to see your energy. But, I am not sure how long you have been following IV. Applying for 485 is only part of the IV agenda. Read the home page. Everyone ( or most of us ) realises this is just a battle won. But it is a big one and the first one with tangible benefits as far I can remember.

    I guess what I am saying is IV will address what you are saying. And we need people like you to energize people like me.

    a) Most banks have wiring fee ( $45)

    b) You must fill up a wire application every time.

    c) The bank which waived Wire Fee (suppose BOA ) sometimes convert $$ to Foreign currency right here at US,there by drastically reducing the Exchange Rate (once again they are private banks - we can't dictate their exchange rates)

    I joked with the BOA manager when he was trying to rip me off that way and asked him frankly whats the workaround - he told me to do a domestic USD wire to SBI-NY and instruct them to carry USD all the way to Foreign country (via International Wire) and then convert using SBI-India exchange rate which is fantastic.

    Who will do all that or lose money? These are the days for ONLINE-ACH man - Free transfer by mouse !

    Why don't you all just wire the money?
    Some banks waive its fees if you have a premium account with them.

    I agree that recapturing lost no's from previous years will be the best possible solution.But to do that we need intervention from the congress and the President needs to sign a bill to recapture the lost no's.To accomplish this goal we need to keep up the momentum generated from this june bulletin fiasco and intensify our lobbying efforts in Washington.
    Kudo's to the IV core for their strong campaign in championing our cause.

    Did you ever dream that USCIS will respond and have the flower campaign on ther website...
    I didnt atleast.

    President is in favour of illegal immigration and may be legal too.. but he cant go for new laws until he fixes the legal immigration syatem.

    Not sure about the increase in fees here is what i have seen comparing it to INA and subsections...


    1. Higher wage requirements defs being added to definitions seciton in INA [Immigration and Nationality Act], Requirement of Internet posting, wage determination.

    2. 90 Days being replaced as 180 days for non displacement option

    3. No consulting for H1B employees based on the Recruitment (F) section.

    4. SEC 102. I states if no. of employees > 50 , sum of [H1B, L(1,2)(L1A, L1 , L2 Perdef 101(a)(15)(L)))] should not exceed 50% of No. of employees. No more H1B's

    5. Sec 111. mispresentation period increased to 24 months from 12 months, USCIS will conduct audits for all employers if no. of employees > 100 and no. of H1 employees > 15% , Publish publicly those reports

    6. Failure to meet a condition increase from 1000 to 2000 , failure for misrepresentation increased from 5000 to 10000. Employer will be liable for employees lost wages and benefits.

    7. illegal : H1B non immigrant to pay a penalty for ceasing an employment with employer before the agreed date, failure to provide common benefits health , life , disability , insurance , retirement , savings, cash/noncash bonus etc...

    8. with in 90 days of enacting S887 , secretary of labor will provide website to post these positions on labor department website.

    9. stream line of job classifications and roles with 1 year of enacting of S887...

    10. DOL can hire 200+ employees to fill these requirements ;)

    + l1's I have not gone through....



    Newer version is - as should've been expected - more protectionist than before.

    1) It prohibits H1B workers from working in contract positions.There is a redundant provision for the L1 visa as well (there is already a law which does this for L1). However it doesn't prevent American companies from keeping these contract workers in India or elsewhere and co-ordinate the work through web-conferencing, video conferencing, VPN/VNC etc.

    2) It increases H1B fees by another 1000 dollars. There will be the added cost of advertising on DOL website. Also, the legal costs of navigating the audits. It also enables Tort attorneys to sue the companies on behalf of labor unions such as IEEE-USA, PG, Bright Future Jobs, Zazona etc. In essence it makes the whole visa program unviable. American companies cannot participate in the visa program without letting the DOL and the Tort attorneys poking their noses in the daily functioning of Corporate America. Imagine which company will apply for H1B when you'll have ads airing on TV from Tort attorneys - 'Have you been displaced by H1B worker? Call 1-800-TORT-ATTORNEY'?

    3) It has a whole gamut of so-called 'H1B/L1B worker protections'. Unless and until the complaining foreign worker's visa status/GC status is protected against employer retaliation, these provisions will remain only on paper, as foreigner workers facing the prospect of forced departure from the country will not complain - extra worker protections or not. They might as well scrap these provisions and save some trees in the process!

    4) It retains the provision that H1B/L1 worker must be provided all originals for H1B, Green Card etc. However this will be moot, as there won't be many H1B/L1 workers left in the US to take the benefit. They would already have moved to their home countries, brining the salaries down in their home countries die to excess supply. This combined with technical enablers are going to make outsourcing HOT. I think it's a good time to invest in the stocks of these outsourcing companies. Their returns are going to increase exponentially in a year. I am not surprised, if these companies send a 'Thank You' note to Senators Durbin and Grassley for making such a windfall possible.


    If this year only 44,000 visas were used after half a month, wait until this law passes. There will already 10,000 or less visa applications. On a short term basis wages will sky-rocket, when companies are already struggling to make the ends meet. This will definitely make the usage of technological innovations such as the ones mentioned in point 1 more appealing to the companies. In the long run Outsourcing will become cheaper and more attractive.

    Faced with accute worker shortage and unreasonably high-salaries driven scarcity in an economy under recession, Companies will have only 3 options. 1) Announce bankruptcy and get out of business salvaging what they can 2) Leverage technology to do outsourcing circumventing the need for visas 3) Beg the government for another 'Stimulus' and more borrowed money from the Chinese to pay the salaries.

    This will hit hard the humanitarian immigration for refugees, asylees etc. USCIS is a government department run on visa application fees. As H1B fee-base reduces US government will have to appropriate more funds to USCIS to keep these programs running. The cost of these programmes will increasingly be borne by the American tax-payer. As jobs keep getting outsourced at a much faster speed tax-base formed by these H1B/L1 workers will shift to other economies benefiting them, the government will have to increases the taxes to make up for the difference. No doubt this will increase the tax burden on an average American - even those who had nothing to do with H1B, pro- or against.

    The day this law passes will be a great day for Outsourcing, and a sad day for America.

    As I thought about this further, I figured out the data is even worse than I thought earlier, as this may not have any 2007 numbers. People who filed their labors in 2007 were still waiting in july of 2007. So this data is only upto late 2006. Now the figures could be

    Our immigration doctor, as a std. practice, don't do TB test during pregnancy. That's the reason we didn't do TB test for her during July 2007 fiasco.

    not sure, but one doctor said its absolutely OK to get a TB test during preg...so we looked for an other doc...

    I am sure many here like me have the same question. Why is that Macaca has to make sure that he answers every single post? Why is that he makes tricky comments (sometimes offensive) and expect everyone to join him? I am with IV for almost 8-9 months now and have contributed to my ability, financially as well as by being active on this forum. But lately I am seeing that Macaca person all over the forum. And frankly it is becoming little annoying now.
    I beg the max because I don't think we can do anything without the lobbying firm and other lobbying activities by core, and the contributions are < 20% of the money required. Please convince me that I should stop begging because !@#$%& or explain how to beg when we have < 3% contributing members in 45 days. In other words, please resolve the begging issue (by possibly explaing that we don't need the lobbying firm and/or other things). This is question 1.

    The following will be neglible if there is an implementable answer to question 1.

    The numbers in the following are low and the list is not complete. Lets assume the complete laundary list with higher numbers.

    Consider a retrogressed member X that uses the following quote to decide that Hill (with lobbying firm) and grassroot lobbying is important.

    Most people struggle with life balance simply because they haven't paid the price to decide what is really important to them.

    X again uses the above quote to decide the following. What are the arguments against this decision? This is question 2.

    Contribute financially and help in financial contributions from others so that we can lobby on the Hill, and
    Help with grass root lobbying (legislators + media), and
    Ignore the laundary list rather then expect everyone to meet X's requirements.

    The two questions are for everyone. Some members have gone over these issues a couple of times in the last 2 months. Please respond ONLY if you have an argument for question 1 and/or an argument for question 2.
