    Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous.But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series.We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. We being here is best for our country and our economy.

    Paid membership irrespective of the amount of payment will drive away the people. With all dues respect to IV, there are defintely other places where you can get good(if not better) information for free.
    Strength of online communities is always the members...the higher the members the better.

    Having said that, I kind of disagree with the punishing the wrong answers with a $5.00...most of the answers in these forums are people experiences and they are not legal professionals. People will not be able to share the experiences openly/freely. I think, it's the responsibility of the questioner to pick the right answer and donate for the value that he/she deems the question is worth.

    I would like to share my experience and it may help some people here.
    My H1 was sponsored by company A when I was working with them on OPT. I paid $3000 for H1 filing and attorney fees and company A gave me the H1 approval notice only after I signed an agreement that I would work for atleast one year with them.
    Afetr 1 month of my H1 approval, I got a better job offer from company B and I got the H1 transferred. I notified my client and company A who threatened to revoke my H1, take me to court etc etc. They also withheld 4 weeks of my pay.
    After joining company B, I filed a complaint against company A with DOL that they withheld my salary and also they demanded H1 fees from me. After 2 weeks of that complaint, my salary was deposited into my account and DOL was looking into my complaint about H1 fees. This case finally got resolved last week after about 18 months, when DOL finally persuaded company A to pay $3000 back to me.
    I would request everyone who is a victim of these blood sucking employers to
    take every possible action against them. There's a very little chance that they would go to court because they are themselves involved in gross irregularities.

    Hats off to you. We can clean these bodyshops if everyone follows this path.

    This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.

    Few points:

    1) having gc is a privilege not a right.

    2) US has every right to choose whom they want to have in their country.

    3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.

    4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)

    5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.

    Wake up friends, you have options. Don't let your life depend on you application status.

    Define which Indian community?
    Gujratis who own motels and shops and will want more family immigration vs H1B

    or

    Indians who are now citizens. They will want less Indians to reduce competition for their jobs or for their children.

    or
    Desi H1b, students EAD etc...
    They are a scared lot anyways and only worry about their immigration status and making dollars. Go tell them about IV if you can?

    You are right in the sense of returns but I am also looking at investing ,not 50 lakhs but small amts. The rturns may not be good but the main reason I think people invest is because of the surity that the land price appreciates more than 50% and be sure your principal is safe compared to stocks or other.

    Just my 2 cents .Let me know if somene think otherwise

    They want to charge $8500 for every renewal . I have a better idea here , make H1 valid for 3 months instead of 3 years, More money for these guys.

    All of these guys are competing give amnesty at the same punishing employers who play by the rules.

    These guys should be ashamed themselves. I dont be suprised if some of desi consulting companies encourage people to convert from H1 to Z1.

    So, is it a good idea to wait until next week and then decide the course of action.
    Can we send another application just in case? Has anyone talked to their lawyer. As per USCIS, even if they send the application back, it might take 30 days to receive the application. (Understandable, since it is USCIS).

    There is not much we can do. From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

    Stay tuned and I will keep on updating here on this nice thread that you created...i really appreciate it. Keep up the good work buddy!!

    A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on and we don't believe it can do anything. The sooner IV accepts it, the better. I have seen this personally in talking to people and you can see the evidence with less than 300 people contributing. IV needs to produce results first.

    Before you ladies jump on me with your (p)curses for personal attacks, read on.

    IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

    Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision,like the amount of the tax you pay, your political view, your education level,etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.

    Oh, come on. I think situation is much more simple than that. I wonder if FBI really got ONE bad guy among H1b poor souls. FBI perfectly knows that it's just stupid to suspect a person who lived on same place for years, personally went to fingerprinting, submitted all kinda information about himself and humbly waiting for GC in being some "threat".

    Because of that FBI considers us "low priority", simply - they don't care about us. But the law requires them to check us, so those who got "no match" automatically pass without any human intervention. But those who by some reason "matched" are awaiting for some FBI dude to push couple of buttons on his computer. But since FBI dude will be first considering more important things to do, those couple of "button presses" might take couple of years.

    This is how I see it. If that's true, then ironically if some of H1bs would be involved in drug trafficking, prostitution or would really posses any threat - namechecks would be going really quick.

    Is Money Behind USCIS Move To Have Department Of State Take Unprecedented Action To "Update" July Visa Chart?

    Was the Department of State's unprecedented action on July 2, 2007, issuing an "Update on July Visa Availability" closing off visa availability for the rest of the fiscal year for employment based cases and essentially gutting its July visa bulletin (which opened the employment based categories EB-1 through EB-3 for adjustment of status applications) all about the money with U.S.C.I.S. in the role of culprit? We believe the answer unfortunately is "yes" and reflects U.S.C.I.S.'s desperate desire to grab its huge future fee increase from individuals that it saw slipping through its fingers. U.S.C.I.S. undoubtedly perceived its expected windfall of hundreds of millions of dollars through its outlandish July 30th increase in fees for petitions and applications (average increase 66%) threatened by the July visa chart which would allow many employment based individuals and their families to beat the fee increases. A typical family of four (husband, wife, child aged 16 and the other 12) applying for adjustment of status currently pays $1,605 to U.S.C.I.S. (including I-140 charge). That same family on and after July 30th would pay $4,105, an increase of $2,500, or 255%. If one multiplies those figures by at least 100,000 ( $250 million difference),[1] one can imagine the explosive temper of top U.S.C.I.S. officials when they saw the Visa Office July chart. U.S.C.I.S. has made no bones that it is depending upon the fee increases to fund its proposed systems and structures for the 21st century.

    The Visa Office made it clear through the updating of the visa bulletin that its update was only because of U.S.C.I.S. action using the phrases "The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month....", and "As a result of this unexpected action....." The Visa Office cited these efforts as resulting in the use of almost 60,000 employment numbers. It is also clear that the Visa Office had no wish to defend U.S.C.I.S. when it issued its update on July 2nd. Whether it retains its stance in the future of washing its hands and pointing the finger at U.S.C.I.S. remains to be seen in light of probable Administration pressure to spin the story in a more positive light to the government as this Administration has exhibited a continual attitude of "soaking" immigrants, legal or otherwise ( $25,000+ for a family of four to immigrate under the recent fallen Senate bill ( See our article, "$10,000 Required For Earned Legalization and Adjustment Under the Secure Borders, Employment Opportunity and Immigration Reform Act", http://www.alanleelaw.com/english/articles/a2007-05-26.htm), which figure was modified from the earlier Administration proposal of $82,000+ ( See our article, "Mr. Lee's Comment to March 28, 2007 White House Immigration Reform Proposal - Z Visas", http://www.ilw.com/immigdaily/digest/2007,0403.shtm in "LETTERS" section), the passed amendment to S. 1639 raising H-1B surcharge fees to $5,000 on top of the fraud ($500) and filing ($190) fees, and the rapacious July 30th U.S.C.I.S. fee increase). The author recalls his telephone conversation with Charlie Oppenheim, the chief of immigrant visa control and reporting, Visa Office, in December 2004 concerning the 101,000 "pool numbers", in which Mr. Oppenheim gave no credence to U.S.C.I.S. figures that the agency had cleared over 100,000 cases (including dependents) between April and November. (The exact differential was 115,000 cases, a rate of about 16,400 per month). The author has no knowledge of the exact number of cases that U.S.C.I.S. claimed to close in June for the State Department to announce that almost 60,000 employment numbers were used (employment based immigrant visa numbers are also requested by U.S. consulates and embassies), but notes that the vast majority of employment based cases are with aliens in the States who adjust status here rather than consular processing their cases. If U.S.C.I.S. claimed to clear anywhere in the area of 40,000-50,000 cases last month, that number for one month is difficult if not incredulous to believe, and if true would have involved massive shifts of U.S.C.I.S. personnel from other responsibilities to comb through and adjudicate all files of persons eligible to immigrate through employment, or less than careful consideration of the cases. Hopefully the agency was not in such a desperate state as to cut corners to endanger our national security if it was the latter case.

    The facts and the legality of U.S.C.I.S.'s actions will undoubtedly be the subject of multiple lawsuits. However this turns out, the agency and the Administration will wind up with less respect than before. This Administration needs all the good publicity that it can muster in light of its unpopular Iraq war and recent actions freeing Scooter Libby (not even Paris Hilton avoided imprisonment) and supporting Attorney General Alberto Gonzales and creating further public mistrust of the justice system even after confirmation that he and other White House aides politicized the selection of United States Attorneys. Unless U.S.C.I.S. and the Visa Office can change course, this episode will unfortunately become a black eye to all parties as further facts emerge in the coming days.

    You need to find a new employer and a new sponsor. Sorry its harsh but its the best advice we can give you.

    I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? Thanks guys
