    Everybody who reads this thread should either donate themselves or if they have already done so, then make sure you talk to a friend and convince him/her to donate. You are not doing any public service by donating to IV (nothing wrong with those kind of donations). Whatever you donate will actually come back to you as a benefit you really want and in a much bigger multiple.

    In my humble opinion, we should quit paying money to lobbyist or using them. We can represent out case to the powers or authorities concerned much better than what the lobbyists are doing.

    I think while most of america ( people and politicians) doesn't want lobbyists we still hiring lobbyist and paying them money is not right.

    I received an RFE too,but within 2 weeks of submission of my appln.I have already submitted the reuqested RFE.DO you know whats next?Is RFE a normal procedure?Is there any kind of risks,if you get an RFE?Please let me know.
    I guess 13 days after the receipt of notice is a bit too long.I guess you should contact the INS ,incase your RFE notice has been lost or something.

    Am quiet certain that an application will get approved even though there is a request for evidence provided you go through a good lawyer with the accurate documentation as requested by USCIS...
    Is there any way to track an RFE online?? if yes could you provide me the link..Thanks.

    Folks,

    I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).

    For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.

    To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.

    Together we can do it!

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration “services” provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS – a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us – “Case adjudication is based on receipt date” “No, we process applications based on notice date”, “Actually, it’s the processing date that determines which applications are adjusted.” !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their “service” centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America’s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service – once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check one’s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled – we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future.

    you cant do anything. Let the statistics speak for itself. Immigrant commuty(india,china,philipines,taiwan etc ) is the richest community in the u.s.a:).80% of immigrant children have a minimum of BS degree, 38 % have a masters..:DThey live in the best urban cities in the u.s (CA,NY,IL)..

    Do you or anyone who thinks that backlogs are due to labor substitution have any proof to claim so ?
    Even if there were some, they definitely won't be in large numbers. First of all to use a sub labor, one labor had to become available. Do you think there were so many labors floating around to grab one ? I don't think so.
    How come EB3 ROW went "U" if all the backlog was due to labor subs ?

    Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even though they are few...the impact is big... With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. The 3000 - 5000 is just a conservative realistic guess.. not based on any data. Do the Math !!! You might agree !!!

    I really don't understand why people think I am lying????
    When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.

    With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.

    I was even telling my wife about the behaviour and how staff at other offices behave.

    Can someone with a paypal account come forward and take over a fund? Anyone with a paypal account can donate any amount using a nickname and we can publish the nickname along with the amount donated on this thread. That way we have accountability and also have a better idea of how many flowers we can send. That person with the paypal account can then order the flowers on Saturday by the latest.

    Others, if they want, can send the flowers on their own also.

    Just a suggestion... If we can do this, I believe more people will come forward!

    Hi, I am applying for a re-issue of passport to split my given name into Surname and First name (NO spelling changes.. just the name split).

    1) While filling the online application form, what do I need to fill in "Other Address" field? Is it my residence address in the US OR can it be same as the permanent address in India?

    2) How do I indicate my mailing address to the consulate to ship the passport back to me? (I stay far from NYC and I am planning to apply for new passport via FedEx).

    Child beaters need to be taught a good lesson. Because of obvious reasons, you cannot go to the police or immigration.

    I am assuming she doesn't know that you can't go to the authorities. So..(this might sound stupid) you can threaten her that you will report her unless she refunds all the money you paid her. This is the best possible punishment I can think of.

    The letter actually does not mention all degree requirements have been fulfilled. This left me really upset (I asked the dept to fax it directly to company, so I had not seen it).

    It says "XYZ completed all coursework requirements for his PhD in EE at the University ABC, and deposited his thesis on April 11 2007. His degree should then be officially conferred in May 13 2007"

    Obviously course + thesis = all degree requirements for PhD, but I wonder if USCIS might question it. The company's attorney (a highly reputable company) okayed the letter and he said denial is unlikely and that they will either approve it or issue an RFE; but based on my readings of other posts I think there is a fair chance that it might be denied.

    The irony is that I got a letter from the registrar on April 16, but by that time the attorney had already filed with the weaker letter. I asked him to send the other one when quota was still available but he said it was unnecessary.

    Please anyone with similar experience comment.
    Well I don't know how it works. If the letter actually goes as a proof to USCIS or it simply stays with the lawyer. I would say, just wait and watch now. USCIS might ask you for more evidence. They would not simply reject it. SO don't lose hope.

    Hi

    My PD is current now and my wife is leaving to India this October and will be back only next Feb 1st week.

    I still haven't got any LUD on my 485.

    In case if I get AOS Interview when my wife is not here, is it possible to change the date? or will I have enough time to bring my wife back for the interview. Basically, how many days before u'll get the Interview Letter before your Interview Date?
