    Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.

    Yes, very good. Sometime late last year, Texas center issued a procedure to let registerred attorneys (not clients) send them a reminder email if and when their clients PD's become current. That should be done so that TSC can pullout the case and get it cleared.

    Let us all focus on the rally and the things that we have to do to make it successful and not waste our energy on this.. Each one of us has to work to make this rally a success, that is a vow each one of us will take.

    My I-485 was recieved on 7/3/07.

    140 was approved 6/2006 by TSC. See a LUD on 7/28/07.
    My 485 was sent to NSC.
    Still waiting for reciepts/cashed checks.

    If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and foreseeing the demand.

    Count me in for any effort in this direction.

    I think USCIS actions are too random . I do not think they want to see the real projections or the real demands. If they wanted to , believe me it should not have been difficult at all. Nevertheless, the first step towards that would be asking for transparency. The letter and poster campaign can do that.

    first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.

    i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...

    qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
    having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.

    now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?

    I tend to agree with every word you said, it is not EB2 or EB3, in general it is EB community as a whole. Recapture+STEM+removal of country limit, will help us all a lot. Lets just focus on this chore. And not get swayed away with winning and complaining.

    All I did was posting it in August EB2 India/China approvals thread about what I read and heard from an IO. Just to inform people. This visas are not available only for India/China and not for other countries????

    If people think it is not appropriate, the admins can delete all the related posts and threads.

    Every single person who came to DC this time or the time before, or who came to San Jose rally has been told by friends, family and colleagues "Why are you going to DC, let others go, take care of yourself, all problems get fixed eventually, Congress will take care of it".

    They sound very reasonable or try to convince you that they are the reasonable ones and you are being unreasonable by going to the Capitol and working on your cause.

    The truth is...yes, we may be. But we are the ones who will eventually make a difference. If you read the quote from George Bernard Shaw, you will realize that the reasonable men and women will sit around and talk about us, save their time for family and leisure and comply themselves to the system. They will comply themselves to a system that keeps in hanging without a green card for 20 years. They will never be capable of ushering progress.

    The unreasonable ones, the ones like us, who contribute to this cause in various forms, are the gifted ones. We are the lucky ones. For we have the wisdom and the strength to do the unreasonable and get the world to comply to our point of view.


    And flower campaign, the DC rally -- that got bulletin reversed in 2007,
    the popularity of removing per-country ceilings in the offices that exist today and didnt exist before --

    I wish the problem of greencard backlogs get cleared soon, but if it doesnt, I will do this a 100 times again and with same or more passion, determination and purpose. Our energy and determination would outlast and outlive the intertia of Congress.

    Not having participated in any previous efforts, the skepticism I had when I landed in DC vanished the moment you started the training session. You are right, if we are not goaded into action, we are content to refresh the visa bulletin every 1st Friday of the month - why 20? 50 times a day!!

    Never once did I realize that by clicking on refresh button - I am actually doing nothing to change the outcome of what will be published. However, during the training, during our lawmaker meeting in DC - I realized I AM ACTUALLY WORKING TO CHANGE THAT VISA BULLETIN

    I realized that my participation will not bare immediate fruits but just that I added a good dose of Miracle Grow and Water. The amount of sunshine is controlled by the powers beyond me, but IV and I are working to make sure that our plant does not get overshadowed by larger trees. Will I be ready to add more Miracle grow in the next 4/5 months? ABSOLUTELY.

    Every IV member can take this as a challenge or as a request - watch the political environment and follow what is happening on the IV forums and action items. As things get warmer, talk to your bosses, spouses and be prepared to participate in Lobby or Rally efforts that will propel our issues to the forefront and get the solutions (be it in whole or partial). Be prepared to participate. Find reasons to participate in such efforts and not excuses/contention/indifference. If you can't do it, find others to take your spot. Do what it takes.

    We may be high skilled in technology but we have a long way to go in terms of communication - and to find you LOGICLIFE, an excellent communicator - it is a privilege, be trained by him, and to actually be in a meeting with him - Priceless.

    Lastly, I want to say, that I have become so "Unreasonable" and am trying to convince every friend of mine to be active in IV for our issues, that I have come to a point where I want every high skilled immigrant to perceive solutions to immigration the way I do!!!

    Guys,

    My AOS case is pending and I am getting married in Feb next year. I have just found out that my spouse's passport and DOB certificate only has her first name. My spouse is from Indonesia (born and citizen of Indonesia). I am planning to use that to apply in the ROW EB3 category. Does anyone know if firsrt name and no last name on passport and DOB will be a problem for obtaiing an H1B in India and later applying for her AOS when the PD becomes current. Please share your views and have a good thxgiving!

    Look.

    I would have to be an absolute moron to contribute to IV, and to work for it, if at the end it costs me more in getting a green card.

    So, either you think that IV-ers from ROW are morons. Or you want them to quit, and turn this organization into an Indians-only group.

    Its as simple as that. You can quote all the laws in the universe, and come up with all the fancy logic that you want. But what I have said above is what it all boils down to.

    I do not care whether you contribute to IV or not. What I am writing here is law or facts and how it is affecting oversubscribed countries becuse of wrong interpretation of law. I am not here to unite or divide any group. In my level, I am contributing to end retrogression by sending mails to law makers. Even any law passes to remove retro, this misinterpretation of law is screwing Indians and Chinese. A EB2 person from Iran/Iraq/Pakistan with PD 2007 can get GC with in 6 months (right from PERM labor to 485 approval) why should Indian with PD in 2003 has to wait for ever?

    My employer hired me not based on citizenship. They hired me based on their requirement for the job and my skills. They do not care, if I am male or female or Indian or Chinese or Iranian or Iraqi or Pakistani or European. I am penalized for just I am Indian not able to adjust LPR even I have priority date in 2003 after a long wait for Labor certification and 140 approvals. However, if I am from other than India and China I would have got GC with in six months even if my PD in late 2006. If a person with a Priority Date 2007 can become LPR immediately in EB2 category even if he is from a state sponsoring terrorism (provided if his background check is cleared). However a person from India having priority date in 2003 can not become LPR and sitting in dark to hope to see the light at the end of tunnel. How fare it is? Is it not the discrimination by country of birth?

    your frustration at IV and the core.

    You can do that and IV (core or its members) will not bite at you, because we know we are all part of the same movement, with the same frustrations, pain and stress associated with uncertainty. What is really needed is channelling the frustration toward action, mobilization and support at the grass roots.

    The opposition is strong. But if we are to succeed, we need to work together. IV work is not easy. Takes time, commitment and money. Lots of people have been trying to do it for a long long time now. But circumstances and uncertainty/unpredictability associated with the legislature and governmental agency(ies) have always been the deterrent for IV's success.

    Reversal of July 07 VB, multi-year EAD, Extended OPT etc. - IV has played significant roles. Under tough circumstances, IV has been able to obtain temporary measures that provide interim relief to you and posterity.

    The day will come when retrogression will become history. But nobody knows what the calendar date of that day is. I surely hope that the day falls in 2008.

    As a start, have you looked at the High-Five campaign started by a IV member? Please donate $5 for that campaign. That is the least you can do.
