Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..
I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"
I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.
Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

May be your post is the one that I have seen after a long time is pretty much balanced, with usage of good choice of words and very intellectual. Irrespective of you or anybody write the right stuff, there are some or may be a lot of people who have the habit of pinpointing to anything and everything without even giving indepth thought over the logics provided and take the stuff to their ego. People wont improve and the basic mentality never changes. And then comes the band wagon. Every person things of me, myself and I, none thought of us, ours and we.

I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.
Anyway, I doubt if it's anything that can't be fixed; my company is very reputable and our attorneys are already engaged.
You had mentioned in your previous post that your EB2 green card was approved in June 2007or did you mean EAD?
Am I missing something?

I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

The 600K+ number must include EB+FB
In the other FOIA thread, the letter from USCIS says that they cannot identify the country of chargeability until the application is adjudicated (may be pre-adjudicated).
May be these 125,000 are pre adjudicated cases and they might have lot more un processed cases where they cannot identify the application as Indian.
If my guess is correct, I am royally ....

[Mr. Brown] True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.

It is easy to say than do. Flower Compaign worked once because they made a mistake. They can return the flowers to the senders. You cannot make law change in the divided issue that much easily.Hunger Strike could lead legal issues for participants some times. So that is impractical. For arranging rallies IV volunteers may have to work for months to organise. After some people's hardwork only a few hundred people will turn up. So rally will become get together.
I totally agree with you, I used to visit IV a lot, but was just disappointed with the results from some of its members. Not to blame IV core team, but other members who would just come and read blogs. Specially EAD holder's, I hope their eyes are opening up to new realities. Yesterday, my sister in law entered USA from Newark Airport and she witnessed three people holding HIB visas get cancelled at the immigration point, one had EAD.
All we Desi's want is a free ride, same old mentality, don't want to put in any diligence in this matter, but very quick on pointing short comings on others. Blame game!
Point is, we all need to do something radical, sending flowers again and holding a hunger strike, otherwise, keep coming to IV and keep getting disappointed.

Agree with vikki76. Infopass and Customer Service numbers are totally useless. Actually, they can do more harm than good as they will open a SR for you, and then when you call back, you are stuck as you have to wait for 30/45/60/90 days.
I think the following will be helpful (I think what worked for me):
1) Try to get a hold of a polite and helpful IO. Keep calling until you get to talk to a nice IO. Reaching an IO does not take more than 30-60 seconds if you call late in the afternoon.
2) Send DHS-7001 form to CIS Ombudsman
3) Letter to Napolitano
I still havent got a response for a letter to the first lady so I am not sure if that works.

I got paranoid because when I contacted USCIS through service request, POJ and ncsc follow up email in September, I came to know that my application is awaiting visa number when clearly dates for my PD were current since Sept 01. Then I tried calling USCIS repeatedly until I got confirmation that both 140 were indeed in place.
After I initiated these requests, my app moved from "awaiting visa number" to " assigned to supervisor" after October 1st. In fact, on Oct 6th,there was LUD on 485 and on Oct 28th, a Hard LUD on my approved 140.
InfoPass won't help much. Usually they just brush people off saying that wait till your PD is current but IO's on phone give more information.
